Generally, the plan cannot increase COBRA premiums during the 12 month determination period.
There are 3 exceptions to the rule that requires plans to follow the determination period for premiums.
1. Increase to 102% of the applicable premium if the plan previously charged less than that.
2. Increase to 150% during the 11-month disability period.
3. If the continuant changes coverage from one benefit plan to another, adds family members or coverage, and the premium is higher for those plans, the plan may increase the premium amount.
