Federal COBRA law applies to employers with more than 20 employees.
HIPAA applies to virtually all employers (except small, self-funded groups).
Employers that are subject to COBRA and HIPAA must maintain, on site, a COBRA Procedures Manual and HIPAA Privacy Manual.
A leading COBRA administrator estimates that as many as 95% of all employers are out of compliance with COBRA. Most are small employers (those with less than 100 employees).
